I am purchasing a shotgun from a friend who lives in PA. I am a NJ resident and have a firearms ID card. Does this transfer have to happen through a licensed gun dealer or can this happen privately?

I found this document online...

http://www.njsp.org/info/pdf/firearms/sp-634.pdf

but I don't think it gives me the right to transfer without a background check.

any advice?

Call the state police firearms unit. They will answer the question. I believe private party can only be residents of the same state under federal law, but I think that and can't tell you if it is true.

True. Federal law say all interstate firearms sales must go through a FFL and be legal in the state where you live. I'm not sure of what the PRNJ requires but I would go to a FFL and let him handle it.

thanks for the info guys. You were right, it had to go through a FFL. I had to pay a fee to the gun shop and a $15 background check. All total it was almost $60 in fees! One shop wanted $125 to complete the transaction . It almost makes it not worth it to buy a gun from another state!

What about the reverse of Sebastians case? I live in PA and want to buy a shotgun from someone in New Jersey. Are the rules the same? Do I need to go thru an FFL , Does he, or do we both have to?

If he brings the gun to you in pa and you pay him its yours hand guns thats a different story .any consileable gun must be registerd If you buy a weapon at a store it must be registerd rifles and shot guns (not muzzle guns)they can be shipped to you direct the same as ammo. I have both and use all of them In pa I'v been stopped in the woods and have never had a registration checked shell capacity yes ,carry permit yes ,gun ownership no and don't think that they can't do that if they want to . In pa they can check what is called pcic if its registerd or not but hunting weapons are personal property, assault weapons you get a little sticky on that one.First of all you can't hunt with an assault weapon in pa. but check your local area to avoid a problem Not game wardens but some small town police departments don't give there police much training don't know jack S#$t about the law .:huh: I worked 23 years in philly and retired and had so problems all due to lack of training on there part but they are just tring todo there job and get home at night:o

In florida you just need your firearms ID card from NJ and they'll sell to ya. Really not sure about registering it in NJ when you get it back here-this is for a shotgun tho. Never tried with handgun/rifle.
