Consideration for final passage of an ordinance to remove hunting in Wall Township is moving forward. Below is a copy of the Ordinance. Please note, in a thinly disguised attempt to circumvent state laws the committee may have recently removed the word “hunting.” However, it is a matter of public record that the intention of the township is to remove hunting. (See below)

It is critical for Wall Township residents to attend whether or not they are hunters. The more Wall Twsp residents who speak on behalf of hunting and the need for deer management the better. Remember, Wall Township is neglecting to ensure that Wall residents have a deer management plan that helps ensure their safety by minimizing auto/deer collisions. The same applies to anyone who travels the roads of Wall Twsp. They are also neglecting the destruction that occurs to resident’s landscaping.

It is also important that all concerned sportsmen and sportswomen, regardless of where they live, show their support by attending and speaking of the need for game management and the history of hunting as a safe activity. Facts and figures should be used where possible. Everyone should summarize by saying that you VOTE. We should be dressed appropriately – blazers and suits preferred but not necessary. Dress neat and clean. NO CAMO, OUTDOOR GEAR, BLAZE ORANGE, ETC. We all should show respect when addressing the committee.

Background:

Wall Township has been at odds with the Monmouth County Park System over hunting on county property. During the November 2007 committee meeting resident Mr. Gary Faraci is on the record saying he was in contact with the county advising that allowing deer hunting is in violation of Township ordinances. (See below) There have been NO reported hunting incidents to Wall Township police according to the minutes.

In April 2008 Mr. Faraci is quoted in an Asbury Park Press article as saying, “It is clear to me that none of our concerns was addressed, despite input and requests from Wall Twsp officials and residents. The change that I would have liked, and expected to see going forward, was for the county Parks Department to abide by Wall Township’s existing nonfirearms discharge ordinance and no-hunting zoning maps…

“The proposal not to add any additional park areas, and the slight reduction in acreage at Tatum Park for hunting does nothing to end illegal hunting in Wall Township,” he added.

Summary:

The intended 650’ perimeter ordinance is not supported by any hunting incidents or multiple complaints. It is apparently the initiative of one or two individuals to remove hunting in Wall Twsp. The original ordinance reveals the true intent of the township committee since it specifies the removal of “hunting” are is a matter of record. One or two people and a Township Committee should not be able to run roughshod over state laws and legal hunting.

What happens in Wall Township may also spread to your neighborhood - let’s stop it now by attending the township committee meeting.

TOWNSHIP OF WALL
ORDINANCE NO. 17-2008

AN ORDINANCE OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF WALL, IN THE COUNTY OF MONMOUTH, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 180 PERTAINING TO FIREARMS

BE IT ORDAINED, by the Township Committee of the Township of Wall, in the County of Monmouth and State of New Jersey, as follows:
Section 1. Chapter 180, “Firearms” of the Code of the Township of Wall, as amended and supplemented, be and the same is hereby further amended and supplemented as follows:
Section 2. § 180-2 Additional Restrictions In areas where the use of firearms is permitted, No person, shall, for any purpose including the purpose of hunting, taking or killing any wildlife, have in his or her possession a loaded firearm or knocked arrow while within 650 feet of any building, or of any school playground or municipal park.
Section 3. All ordinances, or parts thereof, inconsistent with the provisions of this Ordinance be and the same are hereby repealed to the extent of such inconsistency.
Section 4. Should any section, paragraph, clause or any other portion of this Ordinance be adjudged by a Court of competent jurisdiction to be invalid, such judgment shall not affect or impair the remainder of this Ordinance.
Section 5. This Ordinance shall take effect upon its passage and publication according to law.



NOTICE
Notice is hereby given that the foregoing Ordinance was introduced and passed on first reading by the Township Committee of the Township of Wall on August 13, 2008, and will further be considered for final passage and adopted at the Wall Township Municipal Building, 2700 Allaire Road, Wall, New Jersey on September 10, 2008, at 7:30 p.m., or as soon thereafter as the matter can be reached on the agenda, at which time and place all persons interested therein shall be given an opportunity to be heard, and during the week prior to and up to and including the date of such meeting, copies of said Ordinance will be made available at the Clerk’s Office in the Township of Wall, Town Hall, to members of the general public who shall request the same.

Audience Participation
Gary Faraci, Gully Road, advised that the County is
allowing deer hunting in violation of Township ordinances. Mr.Faraci stated that he has already complained three times to the County. The County put a parking lot so that the hunters have
to walk behind the nursery school to Belmar Boulevard to hunt by Hinck’s. The hunters are trespassing with bows and arrows. Mr. Faraci put signs up opposing the hunting but they were stolen.
The County said that it was private property and they couldn’t do anything about it. Mr. Faraci asked the Committee for help in enforcing the Township ordinances. The County advised that they don’t have to abide by the local laws and they have a legal
opinion.

Mr. Faraci noted that NJSA 23:4-16 requires a deer count and studies on Lyme disease and the County has not done these. The Township has the opportunity to challenge the County. There are many other areas open to hunting in Wall Township. Committeeman Clayton advised Mr. Faraci to bring any incidents
to the police and Park Department to build a log. The police looked up the records for the past few years and there were no incidents. Mr. Faraci should be diligent in documenting. Mayor Peters stated that he would consider sending a letter requesting
to carve out 18 acres in the area. The Committee agreed.
